Terms of Services Agreement

Bluestem Films LLC Wedding Video/Photography 

1. Booking and Payment:

 

1.1. Online Payments via the website: When paying for Bluestem's services via the website, the payment must be paid in full upon booking. Should you require a payment plan to spread payments out over a longer period of time, either create an account and then book or contact us via the contact survey at bluestemfilms.com 

 

1.2 Deposit: A booking is not complete until a deposit of 1/3 of the price of the service has been paid for. Clients will have up to one week to pay the deposit before their booking is canceled and opened for other clients. In most cases (see 2.2 for exceptions) the deposit is non-refundable.

 

1.3 Responsibility of Bluestem: It is the responsibility of BLUESTEM to clearly state the price of all services requested and to ensure that the client has had a chance to deny, counter, or otherwise consider the offer before accepting. 

 

2. Cancellation Policy:

 

2.1. Cancellation by Client: In the event of cancellation by the client, the deposit fee is non-refundable. If cancellation occurs less than one week before the wedding date, the full payment is still due.

 

2.2. Cancellation by Bluestem: In the unlikely event that Bluestem is unable to fulfill the agreed-upon services, a full refund will be provided to the client.

 

3. Services Provided:

 

3.1. Scope of Work: The services provided are outlined in the bundle description on our website. Should the client have any questions about the services provided, they should contact Bluestem before booking. By agreeing to this contract, Bluestem assumes the client understands and agrees to the services offered.

 

3.2. Additional Services: Any additional services not outlined in the initial agreement may be subject to additional charges. The client shall be notified of any additional charges before they are made and fully reserves the right to deny additional services for any reason.
 

4. Event Details:

 

4.1. Cooperation: The client agrees to provide reasonable cooperation to enable BLUESTEM Films, LLC to fulfill the agreed-upon services. This includes, but is not limited to, event location, schedule, size, and overall expectations for Bluestem. Bluestem shall provide sufficient means for the client to provide this information. The client shall notify Bluestem of any changes to wedding plans or expectations within a reasonable time before the event day.

 

5. Editing and Delivery:

 

5.1. Delivery Timeline: The final edited video/photos will be delivered to the client within two months of the wedding date. Should Bluestem editors need more time to complete the video/photo(s), they shall promptly notify the client. If the video/photo(s) can not be delivered sooner than two months from the date of the wedding, the client shall receive a refund of all payments except for the reservation deposit. Should BLUESTEM not fulfill any editing services agreed upon, please refer to 2.2 for the policy on full cancellation by BLUESTEM.

 

6. Copyright and Usage:

 

6.1. Ownership: BLUESTEM Films, LLC retains the copyright to all footage and edited materials.

 

6.2. Usage: BLUESTEM Films, LLC may use excerpts from the wedding video/photos for promotional purposes unless otherwise specified by the client.

 

6.3 Wedding Guests: It is the responsibility of the client to notify BLUESTEM staff if a guest does not consent to being in video/photos that will be used for promotional purposes.

 

7. Force Majeure:

 

7.1. Unforeseen Circumstances: BLUESTEM Films, LLC is not liable for failure or delay in performance resulting from causes beyond our control, including but not limited to acts of nature, governmental actions, pandemics, or other unforeseen circumstances.

 

8. Limitation of Liability:

 

8.1. Maximum Liability: The total liability of BLUESTEM Films, LLC for any claims, losses, or damages arising from our services is limited to the total amount paid by the client for those services.
 

9. Governing Law:

 

9.1. Jurisdiction: This agreement shall be governed by and construed in accordance with the laws of the United States, the state of Minnesota,  and the State of the client (in both venue and location of delivery).
